These Terms of Service ("Terms") govern your access to and use of the bangforyourbucktcg.com website (the "Site") and the purchase of products from Bang For Your Buck TCG Inc. ("Bang For Your Buck TCG," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site or purchase our products.

1. Agreement to Terms

These Terms constitute a legally binding agreement between you and Bang For Your Buck TCG Inc. Your use of the Site, including browsing, creating an account, or completing a purchase, constitutes your acceptance of these Terms and our Privacy Policy, which is incorporated herein by reference.

We reserve the right to update or modify these Terms at any time. Changes take effect when posted to the Site. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to make purchases on this Site. If you are between the ages of 13 and 17, you may browse the Site only with the involvement and consent of a parent or legal guardian, who must agree to these Terms on your behalf. By placing an order, you represent and warrant that you meet the applicable age requirements.

This Site is intended for use by residents of the United States. We make no representation that the Site is appropriate or available for use in other locations.

3. Products and Services

Bang For Your Buck TCG Inc. sells trading card game products, including but not limited to sealed booster boxes, booster cases, booster packs, Elite Trainer Boxes, premium collections, starter decks, graded cards, singles, and related merchandise. We carry products from brands including Pokémon, One Piece, Gundam Card Game, Riftbound, and other TCG titles in English, Japanese, and Chinese editions.

Product descriptions are provided in good faith and are as accurate as possible. Product images are for reference only; actual packaging, card art, and set contents may vary.

Availability is not guaranteed. All products are subject to availability and stock limitations.

We reserve the right to limit quantities of any product per customer or per order at our sole discretion.

Prices are subject to change without notice. The price displayed at the time you complete checkout is the price you will be charged.

We are not responsible for typographical errors in product descriptions or pricing. In the event of a pricing error, we reserve the right to cancel the order and notify you.

4. Orders and Payment

When you submit an order, you are making an offer to purchase the product(s) at the listed price. Order confirmation does not constitute acceptance of your order — acceptance occurs when your order is shipped and a tracking number is provided.

We reserve the right to refuse or cancel any order at any time, for any reason, including but not limited to suspected fraud, errors in product or pricing information, or unavailability of product. If we cancel an order after payment has been collected, we will issue a full refund.

All payments are processed through Shopify Payments. By providing your payment information, you authorize us to charge the applicable amount for your order.

You represent that you are authorized to use the payment method provided and that the billing information you supply is accurate and complete.

Fraudulent, unauthorized, or disputed transactions may result in order cancellation and referral to law enforcement.

5. Shipping

We ship to addresses within the United States only. Shipping rates and estimated delivery times are displayed at checkout.

Risk of loss and title for products pass to you upon our delivery of your order to the shipping carrier.

Shipping timeframes are estimates only and are not guaranteed. We are not responsible for delays caused by the carrier, weather, customs processing, or other circumstances outside our control.

Shipping addresses cannot be changed after an order has been placed. Please ensure your shipping address is accurate before completing checkout.

6. Returns and Refunds

All sales are final. We do not accept returns, exchanges, or issue refunds on any products, with limited exceptions as described in our Refund Policy. By placing an order, you acknowledge and agree to our Refund Policy in its entirety.

7. Intellectual Property

All content on bangforyourbucktcg.com — including text, graphics, logos, images, and the overall design — is the property of Bang For Your Buck TCG Inc. and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our prior written permission.

The trading card games and brands sold on this Site are the property of their respective owners. All trademarks, including but not limited to Pokémon (The Pokémon Company International), One Piece Card Game (Bandai Co., Ltd.), Gundam Card Game (Bandai Co., Ltd.), and Riftbound and other titles, are the property of their respective rights holders. Bang For Your Buck TCG Inc. is an independent retailer and is not affiliated with, endorsed by, or sponsored by any of these rights holders.

8. User Accounts

You may create an account on our Site to manage orders and access account features.

You may create only one account per person. Creating multiple accounts may result in all accounts being suspended.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

If you suspect unauthorized access to your account, you must notify us immediately at sales@bangforyourbucktcg.com.

We reserve the right to suspend or terminate accounts at our discretion, including for violation of these Terms.

9. Email and SMS Marketing Communications

By providing your email address or mobile phone number to Bang For Your Buck TCG, Inc. through our subscription forms, our /welcome landing page, our checkout process, or any other opt-in mechanism, you expressly consent to receive recurring marketing communications from us at the contact information provided. SMS marketing messages may be sent using automated technology (including auto-dialers).

Marketing communications may include cart abandonment reminders, new arrival announcements, restock alerts, exclusive subscriber drops, giveaways, and promotional offers. Consent to receive marketing email or text messages is not a condition of any purchase.

SMS-specific terms. Message frequency varies. Standard message and data rates from your wireless carrier may apply. We are not responsible for any charges from your carrier related to receiving our messages. Carriers are not liable for delayed or undelivered messages.

Opting out. You may opt out of email marketing at any time by clicking the "Unsubscribe" link at the bottom of any marketing email. You may opt out of SMS marketing at any time by replying STOP to any text message you receive. To resume SMS messages after opting out, reply START. Transactional communications. Transactional emails and text messages related to your order (order confirmations, shipping updates, delivery notifications, customer service responses) are not subject to the marketing opt-in. These messages are part of normal order fulfillment.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BANG FOR YOUR BUCK TCG INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR ANY PRODUCTS PURCHASED THROUGH IT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR PURCHASE EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM. YOUR USE OF THE SITE IS AT YOUR SOLE RISK.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Dispute Resolution

Governing Law

These Terms and any dispute arising from your use of the Site or purchase of products are governed by the laws of the State of California, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any formal dispute, you agree to first contact us by email at sales@bangforyourbucktcg.com and attempt to resolve the dispute informally. We will make a good-faith effort to resolve any issue within 30 days of receiving your notice.

Binding Arbitration

If a dispute cannot be resolved informally, any and all disputes, claims, or controversies arising from or relating to these Terms or your purchase shall be resolved by binding arbitration conducted in the State of California, under the rules of a mutually agreed-upon arbitration provider. The arbitrator's decision shall be final and binding.

No Class Actions

You agree that all disputes will be resolved on an individual basis only. You waive any right to participate in a class action lawsuit, class-wide arbitration, or any representative proceeding against Bang For Your Buck TCG Inc.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms and shall not affect the validity or enforceability of the remaining provisions.

15. Changes to Terms

We may update these Terms of Service at any time. When we do, we will post the revised Terms on this page with an updated effective date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
